
Terms of Service
All of our services provided are subject to the following Terms of Service. Please read these carefully before submitting your order. We are only able to start work once we have received acceptance of our Terms of Service. When you place an order with us, you agree to be bound by these Terms of Service. Please contact us if you have any queries or would like further information on our Terms of Service.
NOTE: We can review any particular media that you’re unsure of the contents of, however these items will need to be identified to us before work commences otherwise we will digitise/transfer all media supplied.
Your Privacy
At GetSet2Digitise we respect your privacy and keep the contents of your material strictly confidential. All files and data are deleted from our cloud server after 28 days and from our computer systems 24 months after completion of your job. We will not release, copy, sell or otherwise transfer your personal information or files to any third party. After completion of your order your original media will be available to collect or we can dispose of it upon request. Items must be picked up within 21 days of job completion and we reserve the right to securely dispose of any media not picked up within this timeframe. If you are unable to collect it within this timeframe, you will need to contact us within 21 days of job completion to make other arrangements.
Use of your personal information
We may use your contact information to contact you in the future to inform you about new products and services unless you request us not to.
Copyright
Under copyright law we are unable to digitise video tapes, DVDs or 8mm film marked with copyright; programmes/shows or items recorded off TV; movies; home-made compilation/mix (music) cassette tapes; items recorded off the radio; or any other items marked with copyright, unless you or your organisation owns the copyright.
In accepting our Terms of Service before we start work, you are declaring that the items are your own and that you hold the copyright for them or have obtained the required permission of the copyright holder so please ensure that you own the copyright of any media you provide us with or that you have obtained the required permission of the copyright holder. We may ask to see written permission from the copyright holder. We cannot be held responsible for any breach of copyright caused by being provided with false information. We reserve the right to refuse items that we believe are in breach of copyright and will not digitise these items.
Video Tapes, Film and Photographic media
As a standard rule, the copyright for any video tape, cine film, photograph, slide or negative belongs to the original videographer or photographer.
In accepting our Terms of Service before we start a job, you are authorising us to convert all media supplied, unless otherwise requested. We may occasionally end up digitising copyrighted footage in order to locate your personal footage. If it turns out that any video tape/DVD or 8mm film footage contains copyrighted material we will edit out any copyrighted footage before providing you with a copy. There will be no cost for removing copyrighted footage that is at the start or at the end of any tape/DVD/reel. However if copyrighted footage is interspersed throughout your footage, cost to remove it will be an additional $10.00 – $20.00 per video tape/DVD/8mm film reel (depending on extent of editing required).
Digital copies that end up containing solely copyrighted footage will be destroyed after we have converted your media (meaning we are unable to supply you with the digitised footage).
Music
Under copyright law in New Zealand, it is legal to have a copy of commercially-released music/recordings in a different format (e.g. burned to CD; MP3) for each device you own for your own personal use. So this means for commercially-released Vinyl & Audio Cassettes we can only provide you with your files on either the Cloud or on one USB/hard drive (in addition to CD if required), but you can put a duplicate copy on each device you own (e.g. your smart phone, home computer, or MP3 player). Loss or Damage to Original Materials
It is the responsibility of the customer to ensure that all materials delivered to GetSet2Digitise are free from defects and are of suitable quality for processing by GetSet2Digitise in accordance with the customer’s requirements. We reserve the right to refuse any materials that upon initial inspection appear to have extensive mould or are in an advanced state of disrepair.
Items lost or damaged whilst being sent to or from us are the responsibility of the courier company and are subject to that company’s terms. We will require the use of a “Signature Required” courier for items to be delivered to us. We cannot be held responsible for delivery of any materials sent to us that do not use a “Signature Required” service or that are sent to us via the postal system.
We take steps to ensure that your items are kept safe and secure whilst in our care. Our premises are in a secure building with fire protection and CCTV. We make all reasonable efforts to ensure that your items are returned to you in the same condition in which they were received.
While the utmost care is applied to your original media, GetSet2Digitise is not liable for media damaged during the conversion process. Due to the often fragile nature of analogue media there is a chance that old media can be damaged during playback and will not be fit for conversion. Video and audio tapes that have been ‘chewed up’ or damaged during their lifetime are prone to snapping, as are tapes that have mould on them, or that have been exposed to damp environments. Please note that there may not always be visible signs of mould or degradation of any type on your tapes.
Our conversion equipment is regularly maintained and cleaned to minimise the risk to your media. In the event your tape or film snaps during conversion, we will take reasonable steps to repair it without any obligation to engage third parties. In the event that reasonable endeavours to repair your tape or film is unsuccessful, we will advise you that your media is not fit for conversion and arrange for it to be returned to you. If you are unable to collect in person, the cost of return courier will be at the customer’s expense.
Corruption of Digital Files
We take steps to ensure that your converted files are free from viruses. All our computer systems are regularly updated with anti virus software and we won’t move your files to any computer or device that is not part of our system. As a further safety measure, we will only use and supply unused, brand new USBs to put your files on, reducing the risk of viruses or malware contaminating your files.
Technical Support
Any issues related to downloading files provided via online link (e.g. opening zipped files) are the customer’s responsibility. If you do not wish to receive your files via a link you will be able to opt to opt out of this on our order confirmation form and instead select your storage media preference. Our assistance is limited to any issues opening links.
One-2-One Support Services
One-2-Ones are held at our home office or we can come to an address nominated by you within the Wellington region (subject to availability). Our support services are charged on an hourly basis (minimum 1 hour) as advertised on the GetSet2Digitise website. Appointments lasting longer than one hour are charged at the same rate to the nearest 15 minute increment.
Cancellation
We require a minimum of 24 hours’ notice if you need to cancel your One-2-One session. Late cancellations (within 24 hours of booked session) or non-attendance are subject to a cancellation fee of the equivalent of a one hour session. Consideration will be given to unavoidable circumstances such as illness.
Postponement
There is no charge if you wish to postpone your session.
Payment
When you accept our Terms of Service you agree to pay the charges as outlined on our website or emailed through to you for the services you require.
Once we have completed the work we will email through an invoice for payment along with a sample of your digitised media. Payment will be due within 7 days of invoice by bank transfer. Once payment into our account has cleared we will email through an online link to your files, and if we will be transferring your files to USB/hard drive/CD, we will arrange a time for you to collect your items.
If payment is not received within 21 days, we reserve the right to securely dispose of your items once the 21 day period has expired.
Delivery Times
We aim to complete your order within the timeframe discussed and agreed. There may be occasions where delivery is delayed due to workload and events beyond our control. If there is a delay in your order we will notify you of a revised completion date.
Original Media
If you have opted to keep your original media, you will need to contact us within 21 days of job completion to arrange collection/return. We reserve the right to securely dispose of any media not picked up within 21 days if no contact is made in this timeframe to make other arrangements.
Our Guarantee
At GetSet2Digitise, we strive to achieve the highest possible standards for all of our work. However, if you are not satisfied with the product or service you have received, we will work with you to try and resolve any problems you may have and to settle any issues or complaints quickly and fairly. We will assess any issues raised and will endeavour to rectify, replace or offer a part or full refund at our discretion. Any issues must be raised within 30 days of delivery of your product or service in order for us to rectify.
Please note that given the nature of the original materials we work with, specific results will vary depending on the quality of the original materials and by submitting an order, you acknowledge this.
Our Liability
To the extent permitted by law GetSet2Digitise is not liable for:
- any direct, indirect or consequential damages or loss arising from our services (including delayed delivery of our services); or
- any corruption of your digitised media or loss or damage to your devices as a result of use of files we have digitised for you
other than the points mentioned under Loss or Damage to Original Materials and Our Guarantee. Our liability is limited to the amount of fees paid to us.
Changes to our Terms of Service
We reserve the right to change our Terms of Service at any time. We will display any changes on the GetSet2Digitise website. The version of our Terms of Service that you entered into when placing an order will apply. Our Terms of Service are dated April 2026.
Applicable Law
These terms and conditions shall be interpreted in accordance with the laws of New Zealand and you agree to submit irrevocably to the exclusive jurisdiction of the courts of New Zealand.
